Terms of Service — Vibely

These Terms are a binding agreement between you and Aryan Mehta, an individual operating as “Vibely Space” and based in New Delhi, India (“Vibely”, “we”, “us”), governing your use of the Vibely mobile app and related services. They are the end-user licence agreement for the app.

The sign-in screen tells you that continuing means accepting these Terms and the Privacy Policy, and links to both. By signing in or otherwise using Vibely, you accept them. If you do not accept them, do not use the app.

Both documents are reachable at any time from Profile → Legal & support inside the app.

1. Eligibility

You must be at least 18 years old to use Vibely. By using the app you represent that you meet that age requirement, that you are legally able to enter into this agreement, and that you are not barred from using the service under applicable law or by a previous ban.

We do not tolerate objectionable content or abusive behaviour on Vibely. This section describes the moderation commitment we operate under.

5. Events and meeting in person — important safety notice

Vibely is a platform for discovering events. We do not organise, host, run, vet, endorse, or supervise events, and we do not verify the identity, background, or intentions of any user.

Events are created by users. When you attend one you are meeting people you may not know, in a place we do not control. You attend entirely at your own risk. You are solely responsible for your own safety and for your conduct.

6. Your content


If you believe content on Vibely infringes your copyright, email spacevibely@gmail.com with “Copyright complaint” in the subject line and include:

  1. your name and contact details;
  2. identification of the work you say has been infringed;
  3. identification of the content on Vibely you want removed, and enough detail for us to find it — the event, the group chat, or the profile;
  4. a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law;
  5. a statement that the information in your notice is accurate and that you are the copyright owner or authorised to act for them;
  6. your signature, electronic or physical.

We remove infringing content promptly, and we terminate the accounts of repeat infringers. If your content was removed and you believe that was a mistake, send a counter-notice to the same address with the same details and an explanation.

The same address handles trademark complaints and other intellectual-property claims.


8. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.


9. Service availability and changes

We may modify, suspend, or discontinue any part of Vibely at any time. We aim to give notice of material changes but do not guarantee uninterrupted availability. The service is provided free of charge; no service level is promised.


10. Termination

You may stop using Vibely and delete your account at any time.

We may suspend or terminate your account, with or without notice, if you breach these Terms, if your conduct risks harm to other users or to us, or if required by law. Sections 5, 6, 7, 11, 12, and 13 survive termination.

If you do not comply with these Terms, our Acceptable Use rules (§3), or the Privacy Policy, we have the right to remove your content and end your access to Vibely. We will remind you of this at least once a year, as Rule 3(1)(f) of India’s IT Rules 2021 requires, and it applies to every user wherever they are.

Users in India can raise a complaint about any such decision with our Grievance Officer — named, with response times, in the Privacy Policy §14.2. Everyone can appeal to the same address (§4).


11. Disclaimers

To the fullest extent permitted by law, Vibely is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any event listed will take place as described.


12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or personal injury arising from or relating to your use of Vibely, your interactions with other users, or your attendance at any event.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 50.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.


13. Indemnity

You agree to indemnify and hold harmless Aryan Mehta from claims, damages, and reasonable legal costs arising from your content, your use of the service, your conduct at events, or your breach of these Terms.

15. Changes to these Terms

We may update these Terms. Material changes will be notified in the app or by email before they take effect. Continuing to use Vibely after that means you accept the revised Terms.


16. Governing law

These Terms are governed by the laws of India, and the courts of New Delhi have jurisdiction over any dispute.
