Terms of Service — Vibely

These Terms are a binding agreement between you and Aryan Mehta, an individual operating as “Vibely Space” and based in New Delhi, India (“Vibely”, “we”, “us”), governing your use of the Vibely mobile app and related services. They are the end-user licence agreement for the app.
The sign-in screen tells you that continuing means accepting these Terms and the Privacy Policy, and links to both. By signing in or otherwise using Vibely, you accept them. If you do not accept them, do not use the app.
Both documents are reachable at any time from Profile → Legal & support inside the app.

1. Eligibility
You must be at least 18 years old to use Vibely. By using the app you represent that you meet that age requirement, that you are legally able to enter into this agreement, and that you are not barred from using the service under applicable law or by a previous ban.
2. Your account
- You sign in through Google or Apple. Keep your underlying account secure; you are responsible for activity that happens under yours.
- Provide accurate information. Do not impersonate anyone or misrepresent your identity.
- One account per person. Do not create an account to evade a ban.
- You may delete your account at any time from within the app (Profile → account deletion).
3. Acceptable use
You agree not to:
- post, host, or transmit content that is unlawful, harassing, abusive, threatening, defamatory, hateful, sexually explicit, or that depicts or promotes violence, self-harm, or illegal activity;
- harass, bully, stalk, threaten, or endanger any person, online or at an event;
- impersonate any person or organisation, or misrepresent your affiliation with one;
- post spam, scams, fraudulent events, phishing, or deceptive commercial content;
- infringe anyone’s intellectual property or privacy rights;
- post another person’s private information without their consent;
- host an event you do not intend to hold, or use events to lure people under false pretences;
- scrape, reverse engineer, or attempt to gain unauthorised access to the service or other users’ accounts;
- interfere with the operation or security of the service.
4. Zero tolerance for objectionable content and abusive users
We do not tolerate objectionable content or abusive behaviour on Vibely. This section describes the moderation commitment we operate under.
- Report. Every event, message, and user can be reported from within the app. The reporting flow offers: spam or scam, harassment or bullying, hate speech, nudity or sexual content, violence or threats, fake or fraudulent, impersonation, self-harm or suicide, illegal activity, and other.
- Block. You can block any user at any time, including directly from the report flow. A blocked user is removed from your experience.
- Our commitment. We review every report and act on objectionable content within 24 hours of it being reported — removing the content and ejecting the user who posted it where warranted.
- Enforcement. Depending on severity and history, we may remove content, issue a warning, suspend an account, or permanently ban a user. Banned users lose access to the service. Serious cases may be referred to law enforcement.

5. Events and meeting in person — important safety notice
Vibely is a platform for discovering events. We do not organise, host, run, vet, endorse, or supervise events, and we do not verify the identity, background, or intentions of any user.
Events are created by users. When you attend one you are meeting people you may not know, in a place we do not control. You attend entirely at your own risk. You are solely responsible for your own safety and for your conduct.
We strongly recommend that you:
- meet in public places, especially the first time;
- tell someone you trust where you are going and when you expect to be back;
- arrange your own transport and keep the means to leave;
- do not share your home address, financial details, or identity documents with other users;
- leave immediately, and report the user, if anything feels wrong.
To the fullest extent permitted by law, we are not liable for the conduct of any user, online or offline, or for anything that happens at an event.
6. Your content
- You keep ownership of the content you post — events, messages, profile information.
- You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content solely to operate and provide the service. This licence ends when you delete the content or your account, except for copies retained as described in the Privacy Policy (legal obligations, ban enforcement) and for copies other users have already received.
- You are responsible for your content and represent that you have the rights to post it.
- We may remove any content that breaches these Terms, without notice.
7. Copyright and takedowns
If you believe content on Vibely infringes your copyright, email spacevibely@gmail.com with “Copyright complaint” in the subject line and include:
- your name and contact details;
- identification of the work you say has been infringed;
- identification of the content on Vibely you want removed, and enough detail for us to find it — the event, the group chat, or the profile;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and that you are the copyright owner or authorised to act for them;
- your signature, electronic or physical.
We remove infringing content promptly, and we terminate the accounts of repeat infringers. If your content was removed and you believe that was a mistake, send a counter-notice to the same address with the same details and an explanation.
The same address handles trademark complaints and other intellectual-property claims.
8. Privacy
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.
9. Service availability and changes
We may modify, suspend, or discontinue any part of Vibely at any time. We aim to give notice of material changes but do not guarantee uninterrupted availability. The service is provided free of charge; no service level is promised.
10. Termination
You may stop using Vibely and delete your account at any time.
We may suspend or terminate your account, with or without notice, if you breach these Terms, if your conduct risks harm to other users or to us, or if required by law. Sections 5, 6, 7, 11, 12, and 13 survive termination.
If you do not comply with these Terms, our Acceptable Use rules (§3), or the Privacy Policy, we have the right to remove your content and end your access to Vibely. We will remind you of this at least once a year, as Rule 3(1)(f) of India’s IT Rules 2021 requires, and it applies to every user wherever they are.
Users in India can raise a complaint about any such decision with our Grievance Officer — named, with response times, in the Privacy Policy §14.2. Everyone can appeal to the same address (§4).
11. Disclaimers
To the fullest extent permitted by law, Vibely is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any event listed will take place as described.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or personal injury arising from or relating to your use of Vibely, your interactions with other users, or your attendance at any event.
Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 50.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.
13. Indemnity
You agree to indemnify and hold harmless Aryan Mehta from claims, damages, and reasonable legal costs arising from your content, your use of the service, your conduct at events, or your breach of these Terms.
14. Apple and Google
- These Terms are between you and Aryan Mehta only — not with Apple or Google.
- Apple and Google are not responsible for the app or its content, and have no obligation to provide support or maintenance for it.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Your use of the app must comply with the App Store Terms of Service and Google Play Terms of Service.
15. Changes to these Terms
We may update these Terms. Material changes will be notified in the app or by email before they take effect. Continuing to use Vibely after that means you accept the revised Terms.
16. Governing law
These Terms are governed by the laws of India, and the courts of New Delhi have jurisdiction over any dispute.
This does not take away rights you have where you live. If you are a consumer:
- In the EU/EEA, you keep the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts. You can also use the European Commission’s online dispute resolution platform at https://ec.europa.eu/consumers/odr/.
- In the UK, you keep the mandatory protections of UK consumer law and may bring proceedings in the UK courts.
- In the United States and elsewhere, nothing here waives a right your state or national consumer-protection law does not allow to be waived.
Nothing in this section limits your ability to complain to a data-protection authority — the routes are in the Privacy Policy §14.
